GM Tutoring Terms and Conditions

About
1.1 This sets out the Terms and Conditions ("T’s and C’s") for enrolment with GM Tutoring ("We", "GMT" or "Our"). The parents/legal guardians are to enter this agreement on behalf of their child ("student”). Both the student and parents/legal guardians will need to ensure compliance with the Terms and Conditions. Within these T’s and C’s, "you" and "your" will refer to both the student and their parents/legal guardians. "Queensland School Term" and "school term" refers to the dates set by Education Queensland, which can be accessed at https://education.qld.gov.au/about-us/calendar/term-dates. By using our services, you agree to all Terms and Conditions.
1.2 GMT has the right to make changes to these Terms and Conditions. GMT will keep the most updated version on our website. It is your responsibility to check our website periodically for changes.
2. GM Tutoring Commitment
2.1 GMT is committed to providing an online tutoring service to support your child's academic needs. This includes a live online session with a qualified teacher who will deliver a learning program ("lesson").
2.2 For private tutoring lessons, GMT will work with your child to set appropriate learning goals and will provide a personalised learning program that is tailored to your child's needs. GMT will review and confirm your child's learning goals in the first week of each school term.
2.3 For group tutoring lessons, GMT will provide a learning program for your child’s selected year level and will endeavour to make appropriate adjustments to meet the individual needs and abilities of your child. Each group tutoring lesson will have 3-6 students and one teacher. Group tutoring lessons require a minimum of 3 students to proceed and our schedule is subject to change.
2.4 GMT will maintain the confidential nature of your personal information and your academic performance in accordance with our Privacy Policy.
2.5 GMT will notify you of any changes to fees charged by GMT for its services. You do not need to accept such fee changes, and should you choose not to accept such fee changes you may cancel your enrolment.
2.6 While we make every effort to provide our tutoring service, we are unable to make any guarantee as to whether we are or will be able to provide a service for your particular circumstances.
2.7 If a tutor is unable to attend a tutoring lesson, they will offer a make-up lesson at a mutually available time. If a make-up lesson is not feasible, we will cancel the lesson and provide you with a credit.
3. Technology and Supervision
3.1 It is your responsibility to ensure you have stable internet connection, headphones, and a device (tablet or computer) with a camera, microphone, keyboard, and the latest version of either the Chrome, Mozilla Firefox or Safari browsers. No compensation will be provided for loss of your internet connection or for technical problems with your device.
3.2 You will need to run a test on your device to determine suitability and internet sufficiency. The test can be located at https://app.learncube.com/en-gb/troubleshooter/#/
3.3 You are required to attend each lesson on the date and time that you have booked. You will need to click the lesson link (URL) emailed to you and complete the technical checks before each lesson’s start time.
3.4 If significant time (5 minutes or more) is lost during a lesson due to GM Tutoring technical issues, compensation can be provided through a proportional credit or refund.
3.5 GMT does not take responsibility for the supervision of students. It is the parent's/legal guardian's responsibility to have a responsible adult present at the child’s location during tutoring lessons.
4. Payments
4.1 A non-refundable deposit equal to two Pay As You Go lessons (private or group) will be charged to secure a day and time for all tutoring lessons. The non-refundable deposit is applicable towards the purchase price. Your preferred private lesson or group lesson times are not reserved until GM Tutoring has received your client intake form along with payment. In the event you cancel your secured weekly lesson, your deposit will not be refunded.
4.2 Invoices for 10 Lesson Bundle payment plans are sent after we have received your client intake form. This invoice is due on the Friday prior to your first scheduled lesson. If payment is not received by the due date, GMT may terminate your enrolment.
4.3 Invoices for Pay As You Go (PAYG) payment plans are sent via a fortnightly billing cycle (every second Monday). Payments are due within 5 days of receipt of the invoice. These invoices will cover a 14-day period of lessons, commencing the week after the payment is due (advance payment). If an invoice is not paid by the due date, GMT may cancel the tutoring lesson. For example, a parent/caregiver receives an invoice on Monday of Week 2 which is due on Friday of Week 2. The invoice covers all lessons taking place in Weeks 3 and 4.
5. Full School Term Commitment
5.1 Students are expected to commit to all weekly lessons for the full duration of each school term based on the Queensland State School dates.
5.2. Lessons that fall on public holidays may be offered or made up, but public holidays do not reduce the overall term commitment or fees.
6. Termination Policy
6.1 GM Tutoring requires you to commit to weekly tutoring lessons for the duration of the Queensland School Term as set by Education Queensland. Termination of GM Tutoring services or cancellation of an enrolment within a school term (excluding 2-week cooling-off period) will result in lesson fees continuing to be charged for the remainder of the school term.
6.2 At the end of each school term you may terminate your enrolment with GM Tutoring (for the following school term) by notifying GMT via email.
6.3 Cooling-off Period
6.3.1 If you are not satisfied with GM Tutoring services after the first two lessons, notify GMT via email within 48 hours after your second lesson with a reason for your dissatisfaction. If GMT cannot rectify the problem, you may cancel your enrolment and receive a refund for any outstanding credit (excluding initial two PAYG lessons).
6.3.2 If a written request for termination of GM Tutoring services is not provided within 48 hours after the second lesson, your lesson fees will continue to be charged for the duration of the school term.
7. Cancellation Policy
7.1 Private Tutoring
7.1.1 Cancellations of private tutoring lessons made via email up to 24 hours before a scheduled
lesson start time will result in a full credit to use for a make-up lesson, up to a maximum of 1 make-up lesson per school term for school students and 2 make-up lessons per school term for homeschoolers. School students' make-up lessons can be scheduled on a school
morning, subject to availability. If students are unable to attend during the offered times, the lesson is forfeited. Homeschoolers' make-up lessons can be scheduled in accordance with tutor and client availability. If a suitable time cannot be found within the school term, the lesson is forfeited. Eligible make-up lessons must be used within the same school term and cannot be carried over to the next Queensland School Term. Please note"make-up lessons" cannot be scheduled in the planned weekly lesson time. For example, student cannot attend their normal Wednesday 10am lesson due to an event. Parent emails GM Tutoring 24 hours prior to the lesson. GM Tutoring grants a lesson credit and arranges a make-up lesson outside the student's normal lesson time with the make-up lesson falling on Thursday 2pm for one week only. The following week the child continues with their normal lesson of Wednesday 10am.
7.1.2 Private tutoring lessons cancelled less than 24 hours before the scheduled lesson are not eligible for a credit or refund and will be charged the full cost of the session.
7.1.3 Cancellations of more than (1) private lesson for school students and (2) private lessons for homeschool students within a school term are not eligible for a credit or refund and will be charged the full cost of the session.
7.2 Group Tutoring
7.2.1 Cancellation of (1) group tutoring lesson per school term made via email up to 48 hours before
the scheduled lesson start time will result in a full credit to use for a lesson in the following school term.
7.2.2 Group tutoring lessons cancelled less than 48 hours before the scheduled lesson are not eligible for a credit or refund and will be charged the full cost of the session.
7.2.3 Cancellations of more than (1) group tutoring lesson within a school term are not eligible for a credit or refund and will be charged the full cost of the session.
8. Session Recording and Use of Resources
8.1 Sessions may be recorded for the purpose of internal training and quality assurance. If you do not consent to this, you must notify GM Tutoring via email.
8.2 You must not provide access to or copies of GM Tutoring resources to any third parties. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of GM Tutoring Resources or Services.
8.3 Unless written consent is provided by GM Tutoring, we do not permit audio or video recording of any of our services.
9. Assignment Feedback
9.1 GM Tutoring offers assignment editing and feedback services to students in Years 7-12 and university students. This service includes comprehensive feedback on adherence to criteria, grammar, structure, and content, as well as professional editing to enhance spelling, grammar, sentence structure, and overall quality.
9.2 Students who use the assignment editing and feedback service must ensure that their assignments are their original work and do not contain any plagiarized content. GM Tutoring is not liable for any consequences arising from plagiarism in the student's work.
9.3 Students may request revisions to their assignments within 2 days of receiving feedback. Revisions will be provided at no additional cost.
9.4 GM Tutoring reserves the right to refuse service to any student for any reason. This includes if an assignment is inappropriate, unethical, or violates academic integrity.
9.5 GM Tutoring does not guarantee that the editing and feedback provided will result in improved grades or academic performance.
9.6 No refunds will be provided for the assignment editing and feedback service.
10. Disclaimer of Warranties; Limitation of Liability
10.1 GMT does not guarantee, represent or warrant that your use of our services will be uninterrupted, timely, secure or error-free.
10.2 In no case shall GM Tutoring, our director or employees be liable for any injury, loss, claim or any direct, indirect, incidental, punitive, special, or consequential damages of any kind.
10.3 While we will use every effort to ensure that the lessons will help you achieve your academic goals and support you to develop a growth mindset, we cannot and do not make any guarantees that using our services will improve your academic performance or mindset. If a student does not achieve the results they were aiming for, they cannot hold GMT accountable.
